Discover the Truth About Citizenship in Australia

In short, the Australian Government states that if you are born in Australia, on or after the 20th August 1986 (even if to a parent or parents that are Australian Citizens or Permanent Residents at the time of your birth), you are to submit an application through the Department of Home Affairs website, get it approved and receive a 'Citizenship Certificate' to be acknowledged as an Australian Citizen.

For example, to get an Australian Passport you must prove your Australian Citizenship through this process. This shows the posession of a certified Australian Birth Certificate alone is not sufficient for proof of Australian Citizenship. Even though your Birth Certificate contains details for who your parents are.

Having discovered that the reality of citizenship for many Australians had been hidden, it was needed to be shared. Again those born in Australia on or after the 20th August 1986 are not automatically recognised as Australian Citizens and must 'apply for a certificate' which when granted will validate their citizenship. The Australian Birth Certificate gives sufficient recognition to be educated, bank, drive, vote, work, and pay taxes yet says nothing about citizenship. Currently this is applied for separately according to the Australian Government Department of Home Affairs website. 

Those that seek Australian passports will have presented 'Citizenship Certificates' in order to apply for an Australian passport. Unless going through the passport application process there is no information readily shared and available about ones 'Citizenship' status.

This platform is where the information is easy to access and easy to share.

The Australian Government's Department of Home Affairs website says ‘You may be eligible for evidence of citizenship if you were born in Australia on or after 20 August 1986 and at least one of your parents was an Australian citizen or permanent resident when you were born.’

Why was this never broadcast publicly? We believe the 'citizenship status' of people born in Australia to Australian Parents or Permanent Residents needs to be automated and added to the Birth Certificate.

What is the starting presumption of the Citizenship Act?

It was stated there was a misinterpretation of what the Government is saying for this site to be put together. The statement was 'it is just an administrative process and the Government DOES acknowledge those born in Australia as 'Australian Citizens'.

For there be asked for 'proof' that a matter may be determined, legally, there is a starting assumption/presumption of status and the only way to overcome this is for proof of the opposite.

If under the Australian Citizenship Act 2007and any predecessor legislation, the Australian Government and the Department of Internal Affairs already sees those born in Australia on or after the 20th August 1986 as Australian Citizens Citizen why is the onus of proof on the child or their representative to further prove they are? The onus would be on the Government to prove they are not. That is due legal process.

When there is a need to provide proof that one can meet the Governmental requirements to be acknowledged as an Australian Citizen and receive a 'Citizenship Certificate' there is, obviously, a presumption that the status is 'NOT Australian Citizens'.

If someone with much greater understanding than me could explain how this understanding is wrong and can show it simply and clearly, please contact me.
